1. What is the Wells Fargo Home Loan Modification Settlement?
The settlement is a class action settlement of lawsuits that alleged that from 2010 until 2018, the defendants Wells Fargo Bank improperly calculated attorneys’ fees, causing them to erroneously deny trial loan modifications under the Home Affordable Modification Program (HAMP) to eligible borrowers. Some borrowers lost their homes due to foreclosure. The settlement compensates qualified distressed borrowers.
2. Who is eligible for payment?
Class members are individuals in the United States who applied for a home loan modification or a repayment plan between 2010 until 2018, were denied due to the inaccuracy, and lost their home to foreclosure. The settlement provides compensation for both the named plaintiffs (the “Original Class”) and those that opted out (the “Supplemental Class”).
3. Do I need to file anything in order to be paid?
No filing is necessary for most class members. Payment was sent automatically. You need only complete a claim form by the deadline if you wanted to request additional funds for severe emotional distress.
4. What if I did not receive my settlement check?
If you believe you are qualified but have not received a payment, please contact your state’s unclaimed property division or reach out to the Settlement Administrator.
5. Is there a fee if I participate in the settlement?
There is no charge or fee for class members to receive the benefits of the settlement. The program comes at no cost.
6. Who is responsible for administering the settlement?
JND Legal Administration is an experienced legal settlements administrator and will handle all matters pertaining to the settlement from payments to other inquiries.
